These terms cover the use of this website and the free tools on it. The short version: use the site in good faith, treat the free tools as helpful guidance rather than guarantees, and know that real project work is governed by the agreement you sign — not this page.
1. Using this site & the free tools
The site and its free tools (like the site review, report card, and calculators) are provided as-is, free of charge, to help you understand your website and make better decisions. Their output is informed analysis, not a promise of results — some of it is generated with AI assistance and can be imperfect or incomplete. Before acting on anything significant, verify it or ask me. The AI disclaimer explains exactly how the AI-assisted tools work and what they do with what you enter.
2. Project work is governed by your agreement
Client projects are defined by the specific written agreement you receive and sign before work begins. That agreement — not this page — controls scope, timeline, payment, revisions, and ownership for your project. If this page and your agreement ever disagree, your agreement wins.
3. The client portal
Clients get a private portal for messages, files, approvals, and invoices. It has its own Portal Terms covering accounts, acceptable use, data ownership, backups, and offboarding, and this site’s Privacy Policy explains how information is handled.
4. Payments
Invoices are paid through Stripe’s secure checkout. Card details go directly to Stripe and never touch this site’s servers. Amounts, deposits, and payment schedules are set by your project agreement or invoice, not by this page.
5. Your content and mine
Everything you provide — your logo, copy, images, business information — remains yours. The content of this website (its text, design, and code) belongs to Davis Digital Studio; don’t republish it as your own. Ownership of project deliverables is defined in your project agreement.
6. Acceptable use
Don’t use this site or its tools to do anything unlawful, to probe or disrupt the service, to submit content you don’t have the right to share, or to harvest information about others. I may limit or block access that abuses the service — plainly put: use it the way you’d want your own site used.
7. No warranties & limitation of liability
This website and its free tools are provided “as is,” without warranties of any kind, and I don’t guarantee they will always be available, error-free, or right for your situation. To the fullest extent the law allows, Davis Digital Studio isn’t liable for indirect or consequential damages arising from use of this site or its free tools, and total liability connected to the site is limited to the amount you paid to use it — which, for the free site and tools, is nothing. Liability for paid project work is addressed in your project agreement.
8. Changes
These terms may be updated from time to time; the date at the top reflects the current version. Continued use of the site after a change means the updated terms apply.
9. Governing law
Davis Digital Studio operates from Los Angeles, California, and these terms are governed by California law.
